Whether someone is an employee of your organization is not defined by the tax form you give them. While the classification of a worker has never been cut and dry, any challenge underwent a multi-step analysis and usually in the courts. Under a more employee-friendly federal administration and in states like California, the coin has flipped to a presumption that person is an employee unless proven otherwise (even if you are giving them a 1099).
